KPD Bail System

What way would you prefer KPD bails be done when you plead not guilty:

  • Keep it as is: You cannot bail your character if you plead not guilty, and must wait for your trial

  • Change it: You can bail your character after 3 days, but can't get the bail money back if not guilty

Hello SchoolRP players. I am here with a poll for you that will determine how KPD proceeds with bail & not guilty pleas going forward. As many know, you cannot bail out your character if you plead not guilty, which results in a long wait time before you can play said character again. One solution is to allow bails, as long as the player acknowledges they won't get their money back (as all bails are taxpaid, we cannot hold onto the money or return it if you are found not guilty). Thanks.
 
This is technically misleading, as a Lawyer HU, we as Lawyers are able to file what is called a "Motion to Bail", which allows for your character to be bailed out if they have an accepted non-guilty plea, however, your character is still expected to show up to court and you do not receive the money back, whether you win or lose. This is only something that can be done by the defence attorney assigned to your case which is why it is important for any persons pleading non-guilty to join the Karakura Town Discord server so that we can add you to the Secretary bot utilised by the Government faction to manage cases.

I voted while knowing damn well that I would stand in the heavy majority. Sounds pretty logic that most players would prefer not being stuck in jail while pleading non-guilty.

Considering it on a more global, server perspective however - that would mean a very large amount of people pleading non-guilty and asking for trial so from there on goes a lot of questioning such as :
- Can the Government Faction handle a surge in trials to handle? (it is a genuine question for which I don't have the answer)
- Does the Government Faction want a surge in trials to handle? (like, if they're not happy about it, I'd rather vote no on that poll - for their sake)
- Overall in terms of impact of more trials: would that mean we would start seeing a system of jurisprudence? (not sure if I used the right term here, but what I mean is that ruling issued during a trial, establishes a case law for future cases. E.g. if it was once decreed in court that eating beef counts as animal abuse, then that ruling can be invoked in future courts)
- Would there be any advantage obtained in pleading guilty? E.g. reduced bail/sentence, etc.? (I assume so, because if not, people will massively plead non-guilty as default)
- Would there be special motions which could be issued, where a citizen awaiting their trial after a non-guilty plea is submitted to constraints? (maybe that's already the case? things like - being forced to remain at their residence and/or forbidden from entering certain areas, or even forced to be detained if the circumstances justify it?)

That's all of the side questions I can think of at the moment, but overall I voted "Change it" because it has potential to create more roleplay opportunities and that's the goal here!


EDIT: Considering what celexaprozac brought up, I changed my vote as I feel like a "motion to bail" would be easier to handle than a "motion to detain" (or however it would be called, if created)

I really like the plot of having motions like that. So that would correct the poll in "what should the default case situation be" between
- bailable after 3 days, possible to file a Motion to Detain? (I made that name up)
- detained until court date, possible to file a Motion to Bail
 
I don't think this poll is about what the government does/will do, it's just about KPD procedures.
 
I like the idea of being able to bail after 3 days regardless of a non-guilty plea, but I'd maybe recommend doing a week? Just incase by some magic a trial does occur, but I do think they should get that chance and even risk losing money.
 
I personally think that this could be a good change. Under my understanding, the government faction joined after the KPD, so it makes sense why there would be things that don't really align with each other. I had to learn how Bails work in Karakura specifically, and work my way around it. Sure, it's not perfect in legal terms, but we are not here to see if something is 'good or bad', rather to see how we can make it work for everyone. So in that way, I'd like to thank you, Hiratex, for your time and for posting this.

@Neeryu , to answer your questions:
1. We have been working with around +60 cases over the past couple of months after Tippie took charge, in which around half of them were resolved. On average, cases took a really long time due to the intricacies of setting dates and all, but now that we are trying a new method, we can see more cases being resolved per month. So I don't believe having more cases would be an issue for us right now.
2. We want to help, not saying you said it or anything, but I think I speak for everyone in the faction when I say that we are happy to work for the people and the city. After all, that's our work lol (and our quota and paycheck). It will for sure be a little more stressful to have a sudden rise in cases, but work has to be done for you guys. We cannot just stop.
3. Currently, our cases are independent of each other, meaning that a verdict on X case won't be the same in Y case. Circumstances change, and that is a key take when taking a verdict. Lawyers are more than welcome to use that as evidence to help the Judge decide, but at the end of the day, it's up to the Judge in the case.
4. That's more of a question for KPD right now. Can't answer that from a Government perspective.
5. We can for sure find ways, but that does sound like something that will need to be reviewed on KPD's side in terms of what could be possible and what cannot be possible to do.

I think it is a good idea to change it however, it would be better if, as mo said, you would have to wait 7 OOC days to allow the assigned lawyers to motion to dismiss or motion for summary judgement. Correct me if I'm wrong.
 
This is a very good change. It would take stress of people in jail, and just all together make it easier to not be stuck in jail for a while. Like everyone has different opionins its still a prettty good idea to change it.
